5/09.11.2020 Heard Mr. Sheo Kumar Singh, learned counsel for the petitioner and Mrs. Mahua Palit, learned A.P.P. for the State. The learned counsel for the opposite party no. 2 could not be contacted, in spite of best efforts.
The report of the Mediator indicates that the mediation has been unsuccessful.
The petitioner is apprehending his arrest in connection with Mohamadganj P.S. Case No. 28 of 2019.
The marriage of the informant was solemnized with the petitioner in June 2016. It has been alleged that there was a demand of Rs. 5 lacs and on non-fulfillment of the said demand, she was subjected to torture. Ultimately, the informant was assaulted and ousted from her matrimonial house. The petitioner appears to be the husband of the informant. The allegations levelled are general and omnibus in nature.
On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner.
Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Palamau in connection with Mohamadganj P.S. Case No. 28 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This application stands allowed.
