This criminal appeal is directed against the judgment of conviction dated 18.01.2007 and order of sentence dated 19.01. 2007 passed in Sessions Trial Case No. 273 of 1999 by the learned Additional Sessions Judge, F.T.C-I, Bermo at Tenughat whereby and whereunder the appellant no. 1 has been held guilty under section 376 of the Indian Penal Code and sentenced to undergo R.I for 10 years and to pay a fine of Rs, 2,000 and in default of payment of fine to undergo S.I for two months and appellant no. 2 has been held guilty under Section 323 of the Indian Penal Code and released under Section 4 of the Probation of Offenders Act.
The present appeal has been filed on 31.01.2007 thereafter admitted on 01.02.2007 and the appellant no. 1 was admitted on bail during pendency of this appeal under order dated 12.03.2017. Thereafter the matter was listed on 16.01.2019 but nobody appeared on behalf of the appellants. Today also nobody appeared on behalf of appellants.
In view of the judgment passed in Division Bench of this Hon’ble Court in the case of Angad Singh Vs. The State of Bihar (now Jharkhand) in Cr. Appeal No. 226/97 reported in 2011 (1) JLJR 142 , this criminal appeal is hereby dismissed for default.
