Petitioner is accused in Katkamsandi P.S. Case No. 74 of 2017, corresponding to G.R. No. 1004 of 2017, registered for the offence under Sections 147, 148, 149 and 302 of the Indian Penal Code, lodged on the basis of one written report given by Govind Yadav alleging therein that on 06.04.2017 his son Pappu Kumar Yadav and his friend Ajay Kumar Yadav went to see Mela, but in the evening, he did not return and thereafter, informant contacted Ajay Kumar Yadav who stated that he along with Pappu Yadav went to seek Mela and in Mela one Santosh Kumar called and took him aside, suddenly a huge number of persons armed with lathi, sword, bhujali and brutally assaulted him and his son sustained grievous injury and he was taken to Sadar Hospital, Hazaribagh and from there he was referred to RIMS, Ranchi where he died. He further alleged that Sunil Ram, Rahul Kumar Ram, Bhim Ram and Sikandar Ram have murdered his son.
From perusal of the impugned order, it appears that the name of the petitioner reflected in the confessional statement of Sunil Ram recorded in para-34 of the case diary.
Learned counsel for the petitioner submitted that petitioner is in custody since 14.11.2018.
Learned A.P.P. opposed the prayer for bail.
Be that as it may, keeping in view the period of custody, I am inclined to admit the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribagh, in connection with Katkamsandi P.S. Case No. 74 of 2017, corresponding to G.R. No. 1004 of 2017.
