Heard learned counsel for the parties.

The petitioners have been made accused for the offence under Sections 147, 148, 149, 323, 307, 353 & 295 of the I.P.C and Section 27 of Arms Act.

Learned counsel for the petitioners has submitted that petitioners are innocent and have committed no offence as alleged and they have been falsely implicated in this case. Petitioners are in custody since 21.09.2018. The other co-accused have been granted regular bail in B.A. No.9659/2018 and B.A. No.10798/2018 by this Court.

Learned A.P.P has opposed the prayer for bail.

In view of the facts that co-accused have been granted bail and also period of detention, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of like amount each to the satisfaction of learned J.M. 1^st Class, Godda, in connection with Basantrai P.S. Case No.73/2018, corresponding to G.R. No.1451/2018, subject to further conditions that one of the bailors must be the relative of the petitioners. Further petitioners are directed to submit photocopy of AADHAAR card and cell number before the trial court at the time of furnishing bail bonds in the court below. Further, petitioners shall be physically present in the court below on each and every date fixed by the court below, failing which, the trial court is at liberty to cancel the bail bonds of the petitioners.
