The petitioner has been made accused for the offence under Sections 414,419,420,467,468,471,120B of the Indian Penal Code and section 66(B)(C)(D) of the I.T. Act.
Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence as alleged in the FIR. Hence, petitioner deserves bail.
Learned APP has opposed the prayer for bail.
It appears that petitioner is in custody since 24.09.2018 and charge has been framed on 20.01.2019 and the trial will take some time
In that view of the matter, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 30,000/(Rupees Thirty Thousand) with two sureties of like amount each to the satisfaction of ACJM, Jamtara, in connection with Jamtara Cyber P.S. Case No. 38/2018 and subject to the further conditions as follows:
1. Petitioner is directed to remain physically present before the trial court as and when required by the trial court till conclusion of trial and will cooperate in trial, failing which the trial court will be at liberty to cancel the bail bonds of the petitioner.
2. Petitioner is further directed that alongwith the bail bonds, he will furnish his Cell number and xerox copy of AADHAR Card in the court below.
3. Petitioner shall deposit Rs. 30,000/- in the court below, as security deposit, on or before furnishing his bail bonds ,which shall be subject to the result o the case and will not prejudice the case of the petitioner
