06/06.11.2019 It appears that the defect(s) as pointed out by the office has already been removed by the petitioners by way of filing supplementary affidavit. The bail application however on account of inadvertence was dismissed for default.
Accordingly this application is being decided on merits. Heard Mr. Manoj Kumar Sah, learned counsel for the petitioners.
The petitioners are accused in connection with Poraiyahat P.S. Case No. 47/2018, corresponding to G.R. No. 399/2018.
It has been alleged that in the panchayati held on 13.03.2018 the petitioners assaulted the informant and his brothers on the allegation that their mother practices witchcraft. One of the brother namely Innocent Marandi had died on account of such assault.
In view of the fact that all the three petitioners had participated in the assault which led to death of Innocent Marandi, I am not inclined to grant bail to the petitioners. The same is hereby rejected.
