Heard the learned senior counsel appearing for the petitioner and the learned APP appearing for the State.
Petitioner is an accused in connection with Gumla P.S. Case No. 46 of 2019.
It has been alleged that the informant was induced to purchase land by depositing advance payment of Rs. 9 Lakhs. An agreement was also entered into and it has been alleged that a huge amount has been misappropriated by the petitioner.
Submission has been advanced by learned senior counsel appearing for the petitioner that in the purported agreement the same does not mention any plot number which shows that the allegation itself on the face of it is false and frivolous.
Mr. V.S. Sahay, learned counsel appearing for the opposite party No. 2 while relying on the counter affidavit submitted that the petitioner had induced the informant to purchase a piece of and which did not belong to the petitioner and the amount of Rs. 9 lakhs which was deposited also was not returned.
The petitioner appears to be in custody since 12.04.2019.
Regard being had to the aforesaid fact apart from the period of custody undergone by the petitioner, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S. Case No. 46 of 2019, subject to the condition that the petitioner shall remain physically present on each and every date before the learned trial Court till conclusion of trial.
