Heard learned counsel appearing for the petitioner, the learned APP appearing for the State and the learned counsel for the opposite party No. 2. Petitioner is an accused in connection with Patratu P.S. Case No. 168 of 2018 (G.R. No. 726 of 2018).
It has been alleged that the husband of the petitioner had entered into the agreement with informant to sell Hywa Truck bearing registration No. NL03A-5353 for Rs. 10,00,151/-. A total amount of Rs. 4,28,000/- has been taken by the husband of the petitioner as well as the petitioner. Subsequently an owner book was submitted to the informant who started plying the truck. One Anand Giri had submitted an application before the Bermo P.s. that his truck has been stolen. On such information the informant demanded Rs. 4,28,000/- but it was not returned.
The husband of the petitioner had bought the truck from Sunil Kumar Singh. Truck purchased by the husband of the petitioner and Binod Giri is different. The entire transaction with the informant was done by the husband of the petitioner who is now no more. The petitioner has been implicated since certain cheques were issued by the informant in her name. The petitioner is in custody since 09.06.2018.
Regard being had to the aforesaid facts, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ramgarh in connection with Patratu P.S. Case No. 168 of 2018 (G.R. No. 726 of 2018).
