Heard learned counsel appearing for the petitioner and the learned APP appearing for the State assisted by learned counsel for the informant. Petitioner is an accused in connection with Special POCSO Case No. 02 of 2019 arising out of Loyabad P.S. Case No. 63 of 2018.
It has been alleged that the daughter of the informant had gone out for defecating on 02.11.2018, but she did not return. The informant had suspected that the petitioner had eloped with his daughter.
The victim in her statement recorded u/s 164 Cr.P.C. has stated that she had left the house due to the torture meted out to her by her step mother. She called the petitioner with whom she was having an affair for 8 years. The petitioner had told her to return home. She refused and both went to Jamtara where they solemnized marriage. They shifted in a rented house for 15 days. The petitioner had taken her because she had but pressure upon him. The petitioner is in custody since 23.03.2019.
Regard being had to the statement of the victim recorded u/s 164 Cr.P.C., the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cumSpecial Judge, Dhanbad in connection with Special POCSO Case No. 02 of 2019 arising out of Loyabad P.S. Case No. 63 of 2018.
