4/14.02.2018 Heard learned counsel appearing for the petitioner, learned counsel for the State and the learned counsel for the informant, who opposes the prayer for bail.
The petitioners are accused for allegedly committing offence punishable under Sections 302, 201/34 of the Indian Penal Code, in connection with Karon P.S. Case No. 19 of 2017 [G.R. No. 290/2017], pending in the Court of Chief Judicial Magistrate, Deoghar.
These petitioners happen to be in-laws of the deceased. It is alleged that the deceased, who was the son of the informant, went to the house of these petitioners where he was assaulted and murdered and thereafter, his dead body was thrown on a railway track to give it colour of suicide or a railway accident. There is allegation of torture and assault against these petitioners. It is also alleged that these petitioners were always forcing the deceased to reside with his in-laws leaving the widow mother as the wife did not want to reside in the house of the informant.
Keeping in view the nature of allegation, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for bail is hereby rejected.
