Learned counsel for A.C.B filed affidavit today itself. The same is accepted and be kept on record.
Heard learned counsel for the parties.
The petitioner is an accused for allegedly committing offence punishable under Sections 406, 409, 467, 468,109, 120(B) IPC and under Sections 13 (I) (D) read with Section 13(II) of the Prevention of Corruption Act, 1988.
Petitioner is an Assistant Engineer and the allegation against him is that he had committed irregularities in the construction work of PHC causing loss of about 70 lakhs as the construction was inferior in quality.
Counsel for the petitioner submits that petitioner is the Assistant Engineer and the allegation against this petitioner and other accused persons are similar in nature. He submits that since Junior Engineer Anurag Kumar and Pawan Xalxo have already been granted bail by the co-ordinate bench of this Court and further Executive Engineer Braj Kishore Lal @ Braj Kishore Lall has also been granted bail by the Co-ordinate bench of this Court and the case of the petitioner stands on similar footing as that of them, he may be released on bail.
Learned counsel for the ACB opposes the prayer for bail but does not deny the fact that some co-accused persons have been granted bail by the coordinate bench of this Court and the case of the petitioner stand on similar footing.
Keeping in view of the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner, namely, Md. Shabir Ali @ Md. Sabir Ali is directed to be released on bail on furnishing bail bond of Rs. 10,000/-
