7/14.02.2018 Heard learned counsel appearing for the petitioners, learned counsel for the State and learned counsel for the informant.

The petitioners are accused for allegedly committing offence punishable under Sections 341, 323, 354, 504/34 of the Indian Penal Code.

Petitioner Vijay Kumar Soni (in B.A. No. 8296/2017) is the brother-in-law of the informant. It has been alleged, without referring to any date, that this petitioner had taken the informant with him and thereafter kept her in his house. It is also stated that thereafter she could manage to flee from the clutches of this petitioner. On 01.07.2017 she got married and it is alleged that this petitioner and others came with several documents and claimed that the informant had already married with this petitioner and forced her to leave her matrimonial home to live with him.

Learned counsel appearing for the petitioner submits that this case has been lodged with a malafide intention as there was dispute between the father-in-law of the informant and Manohar Swarnkar, Nakul Swarnkar and others.

Learned counsel appearing for the informant opposes the prayer for bail and submits that at the first instance the occurrence had taken place on 31.05.2017 where there is allegation against petitioner Vijay Kumar Soni.

On query, he did not give satisfactory answer as to why no complaint was lodged at that point of time.

After going through the records, I find that petitioner Vijay Kumar Soni and others caught hold of the hand of the informant and was pressurizing her to leave her matrimonial home on the pretext that she has been married to this petitioner.

So far as the petitioners namely, Pradeep Sonar and Pramod Sonar in B.A. No. 262 of 2018 are concerned, the allegation against them is that they had accompanied the main accused Vijay Kumar Soni.

Keeping in view the aforesaid fact, I am inclined to enlarge the petitioners on bail. Accordingly, all the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Koderma, in connection with Domchanch P.S. Case No. 42 of 2017 [G.R. No. 714/2017], subject to the condition that the petitioners shall appear before the court below on each and every date so fixed in the trial and if they fail to appear even on a single date, their bail bonds shall stand cancelled and steps for taking them into custody shall be taken by the trial court. Further, the petitioners shall not try to influence the witnesses or even to informant and if there is any complaint against these petitioners that they tried to influence the witnesses, appropriate action shall be taken against them.
