The petitioner is an accused for the offence punishable under
section 414 of the Indian Penal Code.
It is alleged that 19 Mobile Phones were recovered from the house of the petitioner, which are alleged to be stolen articles.
Counsel for the petitioner submits that the petitioner is in custody since 22.01.2018 and charge sheet has already been submitted against the petitioner in this case.
Addl. P.P. opposes the prayer for bail and submits that the petitioner is involved in selling and purchasing of stolen mobiles.
Taking into consideration the period of custody and the fact that the charge sheet has already been submitted in this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Md. Karim is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rajmahal in connection with Taljhari P.S. Case No. 04 of 2018, corresponding to G.R. No. 47 of 2018.
