Heard learned counsel for the parties.
The petitioner is an accused for allegedly committing an offence punishable under Sections 395 IPC in connection with Nawadih Police Station Case No. 12 of 2016 (G.R. No.355 of 2016), pending in the Court of learned ACJM, Bermo at Tenughat.
It is alleged that Scorpio vehicle was taken away by the miscreants and the said vehicle was not recovered. This petitioner and others are involved in stealing the vehicles and dismantling them into pieces.
Counsel for the petitioner submits that petitioner is not named in the FIR. She submits that petitioner was not put on TIP. She submits that save and except confessional statement of the co-accused there is nothing against this petitioner.
Learned A.P.P. opposes the prayer for bail and after going through the case diary he does not controvert the submission of the petitioner.
In view of the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bermo at Tenughat in connection with Nawadih Police Station Case No. 12 of 2016 (G.R. No.355 of 2016).
