Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioner is an accused for allegedly committing an offence punishable under Sections 302/34 IPC read with Section 27 of the Arms Act in connection with Mohanpur Police Station Case No. 250 of 2017 (G.R. No. 1474 of 2017), pending in the Court of learned Sub-Divisional Judicial Magistrate, Deoghar.
The statement of Md. Abas Sheikh who is the eye witness was recorded under Section 164 Cr.P.C. He clearly stated that Malkhan Yadav has shot the deceased.
In view of the statement which was recorded under Section 164 Cr.P.C, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Deoghar in connection with Mohanpur Police Station Case No. 250 of 2017 (G.R. No. 1474 of 2017).
