Initially the case was registered under Sections 302 & 328 of the Indian Penal Code, but after investigation the police submitted charge sheet under Sections 304 & 328 of the Indian Penal Code.

It is submitted that the petitioner is an old lady and the deceased and others were engaged by her for working in the agricultural land. This petitioner gave food and wine to the labourers. After consuming wine, the deceased died. The wine did not have any effect to the others. It is further submitted that this petitioner had no intention to commit this offence and because of some ailment the deceased died. It is further submitted that this petitioner is an old ailing lady aged about 60 years and she is in custody since 20.07.2017.

Taking into consideration the fact that charge sheet has already been submitted in this case under Sections 304 & 328 of the Indian Penal Code, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Maino Hansda is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Walter Bhengra, Judicial Magistrate, 1^st Class, Dumka in connection with Ramgarh P.S. Case No. 50 of 2017 [G.R. No. 592/2017].
