Learned Addl. P.P. for the State opposes the prayer.
The petitioner is an accused for the offences punishable under sections 461, 379 and 411 of the Indian Penal Code.
It is stated that from the shop of the informant mobile phones worth Rs. 7,00,000/-,a laptop worth Rs. 32,000/-, some bills and important documents have been looted. The petitioner and other accused persons were apprehended and from their joint possession alleged looted four mobile phones were recovered.
Learned counsel for the petitioner submits that only one mobile phone was recovered from the possession of this petitioner, which belongs to the petitioner. He submits that the petitioner is in custody since 18.12.2017 and charge sheet has been submitted in this case.
Taking into consideration the period of custody and the fact that charge sheet has already been submitted against the petitioner, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Janardan Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Maharaj, J.M., Giridih, in connection with Dhanwar P.S. Case No. 368 of 2017, corresponding to G.R. No. 3430 of 2017.
