Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioner is an accused for allegedly committing an offence punishable under Sections 302/34 IPC in connection with Mccluskiganj Police Station Case No. 37 of 2016 (G.R. No. 5721 of 2016) corresponding to Sessions Trial No. 299 of 2017, pending in the Court of learned Judicial Commissioner, Ranchi.
From the FIR it transpires that Sukarmani Devi has given axe blow on the head of the deceased resulting in death of deceased. Only allegation against the petitioner is that the petitioner has caught hold of the deceased when Sukarmani Devi gave axe blow on the head of the deceased. Similarly situated co-accused has been granted bail by this Court in B.A. No. 8018 of 2017.
In view of the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Commissioner, Ranchi in connection with Mccluskiganj Police Station Case No. 37 of 2016 (G.R.No. 5721 of 2016) corresponding to Sessions Trial No. 299 of 2017, pending in the Court of learned Judicial Commissioner, Ranchi.
