Counsel for the petitioner submits that the bail bond of the petitioner was cancelled on 30.9.2013. He further submits that now the petitioner is in custody since 10.9.2017. He also submits that chargesheet has been submitted in this case.

In view of the aforesaid fact, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Baijnath Baitha is directed to be released on bail on furnishing bail bond of Rs.10,000/(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-III, Garhwa, in connection with Complaint Case No. 127/2004 (S.T. No. 59 of 2007), subject to condition that he will appear before the trial court concerned on each and every date of trial, failing which, his bail bond shall be cancelled and necessary steps shall be taken for his re-arrest .
