Heard learned counsel for the parties.
The petitioner is an accused for allegedly committing offence punishable under Sections 395, 397, 412 IPC.
It is alleged that some unknown miscreants looted the truck which was loaded with saaries.
Counsel for the petitioner submits that when petitioner was arrested, on his confession, material was recovered from the house of Md. Seraj. Counsel for the petitioner further submits that petitioner was not put on TIP and there is no criminal antecedent against him. He also submits that charge has already been framed.
Learned A.P.P. opposes the prayer for bail but does not controvert the fact that material was recovered from the house of Md. Seraj on the confession of this petitioner and there is no criminal antecedent against him.
Keeping in view of the fact that petitioner has no criminal antecedent and charge has already been framed, I am inclined to allow this application. Accordingly, the petitioner, namely, Md. Yasin is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Simaria P.S. Case No. 86 of 2017, corresponding to G.R. No. 1068 of 2017, subject to the condition that the petitioner shall appear before the court below on each and every date so fixed in the trial and if he fails to appear even on a single date, his bail bonds shall stand cancelled and steps for taking him into custody shall be taken by the trial court.
