Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner.

Petitioner is an accused for allegedly committing the offence punishable under Sections 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.

It is alleged that the petitioner had uprooted some plants from the fields of the informant, as a result of which altercation had taken place. Petitioner had given knife blow on the stomach of the mother of the informant and another blow on the right thigh of the informant.

Petitioner has remained in custody since 06.09.2017.

Learned counsel for the petitioner submits that there was no intention to commit murder. Both the parties are agnates.

Taking into consideration the period of custody, which is more than six months and the fact that chargesheet has been submitted in this case, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner, namely, Ajit Rout, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate at Deoghar in connection with Mohanpur Police Station Case No.247 of 2017 corresponding to G.R. No.1463 of 2017 with a condition that the petitioner will appear and mark his attendance before the Officerin-Charge, Mohanpur Police Station, Deoghar once in a month and in the event the petitioner fails to appear before the Officer-in-Charge, Mohanpur Police Station in any particular month, the bail bonds furnished by the petitioner shall stand cancelled and the Officer-in-Charge, Mohanpur Police Station will take all steps for arresting the petitioner again.
