3/7.03.2018 Heard learned counsel appearing for the petitioner.
The petitioner is an accused for allegedly committing offence punishable under Section 342, 302, 201 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that it is Shankar Manjhi who is the main assailant and he has been granted bail by a coordinate Bench of this Court in B.A. No. 5161 of 2017. He submits that Ajay Manjhi got his statement recorded under Section 164 of the Cr. P.C. stating therein that Shankar Manjhi is the main accused but Ajay Manjhi has turned hostile and did not support the prosecution case. He further submits that the co-accused Shankar Manjhi was granted bail by a coordinate Bench of this Court. He lastly submits that the case of the petitioner is in better footing than that of the co-accused.
Learned Addl. P.P. opposes the prayer for bail but cannot controvert the aforesaid fact.
Keeping in view of the aforesaid submission, I am inclined to allow this application. Accordingly, the petitioner, namely, Bhola Manjhi is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Ranka, P.S. Case No. 13 of 2015, corresponding to G. R. No. 225 of 2015.
