Learned counsel for the petitioner submits that this being in a dacoity in a jewellery shop and admittedly the jewellery was recovered from the possession of Pintu Kumar Singh, not from this petitioner. It is submitted that the name of the petitioner transpires from the confessional statement of the co-accused.

Learned Addl. P.P. opposes the prayer for bail but cannot dispute the aforesaid submission made on behalf of the petitioner.

In view of the aforesaid submission, I am inclined to allow this application. Accordingly, the petitioners, namely, Pradeep Kumar Rai @ Pradeep Rai @ Predeep Kumar (In B.A. No. 10057 of 2017) and Arbaaj Alam @ Md. Arbaaj Alam (In B.A. No. 23 of 2018) are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Giridih, in connection with Dhanwar, P.S. Case No. 282 of 2017, corresponding to G. R. No. 2545 of 2017.
