Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioner is an accused for allegedly committing an offence punishable under Sections 302 IPC and Section 27 of Arms Act in connection with Hanwara Police Station Case No. 31 of 2017 (G.R. No. 618 of 2017) , pending in the Court of learned Judicial Magistrate, 1st Class, Godda.
The deceased was murdered by some unknown persons. The name of this petitioner has transpired in the instant case on the basis of confessional statement of co-accused Rajendra Mandal.
Counsel for the petitioner submits that allegedly recovered fire arm cannot said to be used by this petitioner which is apparent from the confessional statement of co-accused Rajendra Mandal. The fire arm which was used in the occurrence was recovered from the house of Rajendra Mandal itself. He submits that petitioner is in custody since 12.10.2017.
Keeping in view of the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Godda in connection with Hanwara Police Station Case No. 31 of 2017 (G.R. No. 618 of 2017).
