The petitioner is an accused for allegedly committing an offence punishable under Sections 302/201/34/120B & 379 IPC and Section 17 C.L.A Act in connection with Kamdara Police Station Case No. 15 of 2017 (G.R. No.370 of 2017) corresponding to Sessions Trial No. 353 of 2017, pending in the Court of learned Additional Sessions Judge-III, Gumla.

Son of the informant was murdered.

Petitioner is not named in the FIR. Petitioner was apprehended on the basis of confessional statement of one of the co-accused namely Suraj Singh.

Counsel for the petitioner submits that there is no evidence to connect this petitioner with the aforesaid murder. Nothing has been recovered from his possession. On the basis of confessional statement of Suraj Singh the name of this petitioner has transpired in the instant case. She submits that this petitioner was only keeping an eye on the activities of the police official who was present in the fair, but there is no evidence of committing murder by this petitioner.

In view of the aforesaid position, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Gumla in connection with Kamdara Police Station Case No. 15 of 2017 (G.R. No.370 of 2017) corresponding to Sessions Trial No. 353 of 2017.
