4/28.02.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Section 414 and 34 of the Indian Penal Code, Section 30(ii) of the Coal Mines Act and Section 33 of the Indian Forest Act.
Three tractors loaded with two tones coal each were apprehended. The petitioner is owner of brick kiln. It is alleged the said coal was to be transported to brick Kiln. It is further submitted that the petitioner has got no concerned with the said coal neither he was apprehended on spot. He has been falsely implicated in this case. The petitioner is in custody since 16.01.2018.
Keeping in view of the aforesaid submission, I am inclined to allow this application. Accordingly, the petitioner, namely, Ashok Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ramgarh, in connection with Ramgarh, P.S. Case No. 413 of 2017, corresponding to G. R. No. 1408 of 2017.
