04/27.02.2018. Heard learned counsel for the petitioner. Learned Addl. P.P. for the State opposes the prayer.
The petitioner is an accused for the offences punishable under sections 302/201/120(B)/34 of the Indian Penal Code.
It is alleged that some unknown persons have committed murder of the daughter of the informant.
This petitioner is the husband of the deceased. Earlier a complaint was filed by the informant when his daughter went missing, wherein nothing has been alleged against this petitioner, but later on it has been alleged that this petitioner has committed murder of the deceased. The witnesses examined in this case till date did not support the prosecution case while deposing in the Court.
Keeping in view of the aforesaid facts, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Rejaul Sheikh @ Rejaul Sk is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge -1st ,Rajmahal, in connection with S.T. No. 150 of 2014, arising out of Rajmahal (Radhanagar) P.S. Case No. 27 of, corresponding to G.R. No. 65 of 2014, with a condition that the petitioner shall appear before the trial court on each and every date fixed in the case during the trial, failing which his bail bond shall stand cancelled and the trial Court shall take all possible steps for his apprehension.
