Learned Addl. P.P. for the State opposes the prayer.

The petitioner is an accused for the offences punishable under sections 302,201 and 120 (B)/34 of the Indian Penal Code.

It is alleged that the deceased was taken by these petitioners to see Orchestra in the village. Thereafter, the informant got information that her husband fell in the well. The informant and others went to the place of occurrence and saw that her husband is lying dead in the well.

Counsel for the petitioners submits that there is no eye witness to the said occurrence and no one has seen the petitioner pushing the deceased in the well.

Addl. P.P. for the State and the learned counsel for the informant opposes the prayer for bail and submits that these petitioners called the deceased and have pushed the deceased in the well as a result of which he died.

After going through the case diary, I find that there is no eye witness to the said occurrence and only material against these petitioners is that they were last seen with the decreased and no one has seen the petitioners pushing the deceased in the well and the cause of death is due to drowning.

Keeping in view of the aforesaid facts, I am inclined to release the petitioners on bail. Accordingly, the petitioners, namely, Raju Singh and Mukesh Kumar Yadav are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Chatra, in connection with Pratappur P.S. Case No. 101 of 2017, corresponding to R.N.F. No. 1396 of 2017.
