Petitioner is apprehending his arrest in connection with Chandil (Kapali) P.S. Case No. 145 of 2015, corresponding to G.R. No. 1154 of 2015, registered under Sections 419, 468, 471, 34 of the I.P.C. and Section 12 of the Passport Act.

It is submitted by learned counsel for the petitioner that at best, this is a case of attempt to commit the offence, as it is alleged in the self-statement of SI Bir Kumar I/C Kapali O.P. recorded on 02.12.2015 that the police went to the residential address of petitioner as he has applied for issuance of passport, but the address was not found correct. It is submitted that no passport has been issued. It is further submitted by learned counsel for the petitioner that process under Section 82 of the Cr.P.C. has not been issued against the petitioners.

It appears that the anticipatory bail application of the co-accused i.e. A.B.A. No. 881 of 2016 was rejected on 20.06.2016.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail with imposition of cost of Rs. 5,000/- upon the petitioner to be deposited before the President, District Bar Association, Seraikella-Kharsawan within four weeks. On deposition of amounts by the petitioner, the President will issue receipt to him. The above named petitioner is directed to surrender in the Court below within two weeks from the date of receiving the receipts of depositions and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Seraikella, in connection with Chandil (Kapali) P.S. Case No. 145 of 2015, corresponding to G.R. No. 1154 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

and further on the date of surrender, petitioner shall file the receipt of the aforesaid deposition.

Let the record of A.B.A. No. 881 of 2016 be restored to its original file.

Let a copy of order be communicated to the court below an also to the President, District Bar Association, Seraikella.
