The petitioner is apprehending his arrest in connection with Taratand P.S. Case No. 22/2016 corresponding to G.R. No. 2773/2016, the case registered under Sections 175,379,414,420,34 of the Indian Penal Code and Section 4(i)/1(A) of Mines Development and Regulation Act 1957 and Section 4/54 of JMMM Act 2004.

Learned counsel for the petitioner submitted that although petitioner is director of M/s Jyoti Fuels Pvt. Ltd. and the seized vehicle was registered with the said company but the same has not been seized with the sand and petitioner has no concern with the same. It is further submitted that the driver of the said vehicle has been granted anticipatory bail by the court below.

Learned A.P.P opposed the prayer for bail.

Considering the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M.,Giridih, in connection with Taratand P.S. Case No. 22/2016 corresponding to G.R. No. 2773/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the further condition that on the date of surrender petitioner shall deposit Rs.5,000/- in the court below.

The aforesaid deposit shall be subject to the final result of the case and the same will not prejudice the case of the petitioner.
