The petitioner is apprehending his arrest in connection with the case registered under Sections 379, 411 and 34 of the IPC.

Learned counsel for the petitioner has submitted that the petitioner has been made an accused only on the basis of confessional statement of co-accused. Save and except there is no specific allegation against the petitioner.

Learned counsel for the State has opposed the prayer for bail and submitted that the case diary has been received but the antecedent report has not been received.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The petitioner is directed to surrender in the court below within four weeks and in the event of his arrest or surrender, the court below shall release him on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Dhanbad, in connection with Kanduadih P.S. Case No.105/16, corresponding to G.R. No.3417/16, subject to the condition as laid down under Section 438(2) of the Cr.P.C. subject to further condition is that one of the bailor should be relative of the petitioner.
