02 /08.06.2017 Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Herhanj P.S. Case No.10 of 2017 registered under sections 379/34 of the Indian Penal Code, Section 21 of the MMRD Act and under Section 30(ii) of the Coal Mines Act.

Heard learned counsel appearing for the petitioners as well as learned Addl. P.P. for the State.

It appears from the self-statement of S.I. Sanoj Kumar Choudhary that he received information that in the Village-Serka at the place of Chhaparthe extraction of illegal coal is being done. Thereafter, when he reached near the place of occurrence along with police party, they saw some persons were fleeing, they were chased, but the accused succeeded in fleeing away and on being asked villagers named these petitioners to be the persons who indulge in illegal mining of coal and selling the same.

Learned Addl. P.P. opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions of the counsels and the fact as mentioned above, I am inclined to grant privileges of anticipatory bail to the petitioners. Hence, in the event of their arrest or surrender within a period of three weeks from the date of this order, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Herhanj P.S. Case No.10 of 2017 (corresponding to G.R. No.142 of 2017) subject to the conditions laid down under section 438 (2) Cr. P.C.
