03/08.06.2017 Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with R.I.T. P.S. Case No.99 of 2016 registered under sections 379/411 of the Indian Penal Code, 4/54 of the J.M.T.R. 2004 and under Section 9 of J.M.T.R. 2005.

Heard learned counsel appearing for the petitioner as well as learned Addl. P.P. for the State.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. Further it has been submitted that the petitioner is the owner of so-called alleged trolly No.JH-05-U-9949. It is also submitted that the police has not collected admissible evidence to connect the petitioner with the alleged offence.

Learned APP appearing on behalf of the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant privileges of anticipatory bail to the petitioner. Hence, in the event of his arrest or surrender within a period of three weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella in connection R.I.T. P.S. Case No.99 of 2016 (G. R. No.1328 of 2016) subject to the conditions laid down under section 438 (2) Cr. P.C.
