02 /08.06.2017 Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with C.Case No. 367 of 2017 registered under sections 33, 41 & 42 of the Indian Forest Act.

Heard the learned counsel for the petitioners and the learned Addl. P.P. for the State.

Learned counsel appearing for the petitioners submits that the place of occurrence is not a protected forest land rather it is a village. Though under 10.16 of the Bihar Forest Rules, it is required that in case of seizure of forest products a certificate must be issued from the Mukhia of Gram Panchayat, yet the same has not been complied with. The learned counsel drew the attention of the Court to the seizure list at running page no. 10, where at paragraph 6(Ka) only one witness namely Kameshwar Pandey, Forest Guard has signed but at paragraph 6(Kha) no one has signed.

The Learned Addl. P.P. on the other hand opposes the prayer for grant of anticipatory bail.

Considering the submissions of the counsels and the facts as discussed above, I am of the opinion that it is a fit case where the petitioners namely Mahadeo Sao, Pradeep Sao and Ajay Kumar Sao be admitted to anticipatory bail. Hence, in the event of their arrest by police or surrender within a period of three weeks from the date of this order, they will be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like

amount each to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with C. Case No.367 of 2017 registered under sections 33, 41 & 42 of the Indian Forest Act subject to the conditions laid down under section 438 (2) Cr. P.C.
