When the case is called out, learned counsel for the informant has submitted that process under section 82 Cr.P.C has already been issued against the petitioner on 22.03.2016 and process under section 83 Cr.P.C has already been issued on 07.05.2016.
It appears that this anticipatory bail application has been filed on 09.03.2016 but there was no interim relief granted to the petitioner.
Learned counsel for the petitioner has submitted that proclamation under section 82 Cr.P.C has been quashed by this Court vide order dated 06.05.2016 in Cr.M.P No. 1019 of 2016.
Now, whether this anticipatory bail application is maintainable or not, in my view, the said application is not maintainable.
Learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application.
Permission is granted.
Accordingly, the anticipatory bail application is dismissed as not pressed.
