Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with the case registered under Sections 406 and 420 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner has taken no money from any of the recipients. It is also submitted that petitioner is labour union leader and an old man. He has nothing to do with the welfare scheme of the Government rather for the interest of beneficiaries he helped them with a motive of social work and not for any financial gain.
Learned A.P.P has opposed the prayer for bail and stated that in para-8, 9 of the case diary in which witnesses have supported the prosecution case.
Considering the fact that petitioner is aged about 72 years, he is directed to surrender in the Court below within three weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Ghatshila in connection with Baharagora P.S. Case No. 15 of 2016 corresponding to G.R. No. 102 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
