Heard learned counsel for the parties.

The petitioner apprehending his arrest in connection with the case registered under Sections 376/493 IPC has prayed for grant of anticipatory

bail.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case.

Learned A.P.P as well as learned counsel for O.P.No.2 opposed the petitioner’s prayer for bail.

Having considered the facts and circumstances of the case, the above named petitioner is directed to surrender before the concerned Court below within a period of two weeks. If he surrenders before the Court below within the aforesaid period, he shall be released on bail on furnishing bail-bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of the C.J.M, Jamtara in connection with P.C.R. Case No. 90/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C and further that the petitioner shall deposit Rs.15,000/- in the Trial Court on the date of his surrender by way of ad interim compensation to O.P.No.2 in terms of Section 357A Cr.P.C read with Jharkhand Victim Compensation Scheme. On deposit of the aforesaid amount, the Trial Court shall issue notice to O.P.No.2. On appearance of O.P.No.2 and after proper verification, the Trial Court shall release the aforesaid amount in her favour.

The Trial Court is directed to expedite the trial.

During trial, the petitioner shall not intimidate or try to influence O.P.No.2 or other witnesses. If he is found indulged in such activities, it will be open to O.P.No.2 to bring the same to the notice of this Court by filing an application through her learned counsel, so that after hearing the parties, appropriate order may be passed.

After conclusion of trial, the Trial Court shall formulate the final scheme in coordination with the Secretary, District Legal Services Authority to extend the benefit of the rehabilitation scheme to O.P.No.2.
