Heard learned counsel for the petitioners as well as learned APP for the State.

2. Petitioners are apprehending their arrest in connection with Itkhori P.S. Case No. 06 of 2016, corresponding to G.R. No. 109 of 2016, registered under Sections 302, 201, 34 of the I.P.C., pending in the court of learned Sub Divisional Judicial Magistrate, Chatra.

3. It is submitted by learned counsel for the petitioners that save and except confession, there is nothing against these petitioners. It is further submitted that there is stain relation between the parties.

Learned APP produced the case diary and submitted that in para-15 of the case diary, I.O. has recorded the statement of witness Urmila Devi and Sakaldeo Singh, who have supported the case and submitted that there is stain relation between the parties and in para-21 post-mortem examination report of Lav Kumar Singh is mentioned as death due to asphyxia caused by throttling and the body was highly decomposed.

5. Be that as it may, I am inclined to admit the petitioners on anticipatory bail. The petitioners, above named, are directed to surrender in the court below within three weeks from the date of this order and in the event of their arrest or surrender the court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Chatra, in connection with Itkhori P.S. Case No. 06 of 2016, corresponding to G.R. No. 109 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
