It appears that under order dated 17.09.2016, case diary was called for and the case was fixed for 02.12.2016.

The instant case has been fixed under the heading “For Orders” on the basis of a Bench Slip.

Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner is apprehending his arrest in connection with Giridih (Town) P.S. Case No. 102 of 2016, corresponding to G.R. No. 1158 of 2016, registered under Sections 420, 467, 471, 120B of the I.P.C. and Section 66 (C), (D) of Information Technology Act.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. It is further submitted that one of the similarly situated co-accused has been granted bail by this Court vide order dated 22.09.2016 in A.B.A. No. 3670 of 2016.

Learned APP has opposed the prayer for anticipatory bail.

Be that as it may, I am inclined to admit the petitioner, above named, on anticipatory bail. The petitioner is directed to surrender in the Court below within two weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Giridih in connection with Giridih (Town) P.S. Case No. 102 of 2016, corresponding to G.R. No. 1158 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
