Learned counsel for the petitioner is directed to remove the defect as pointed out by the office in course of the day.

2. Heard learned counsel for the petitioner as well as learned APP for the State.

3. The petitioner is apprehending his arrest in connection with Chirkunda (Galfarbari) P.S. Case No. 222 of 2016, corresponding to G.R. No. 3230 of 2016, registered under Sections 414, 120B of the I.P.C. and Section 33, 42 and 41 of the Indian Forest Act and Section 30 (ii) of the Coal Mines Act.

4. Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. It is further submitted that petitioner had leased out the factory in question to one Sri Balram Prasad by virtue of a registered deed of lease dated 28.05.2012 on monthly rental, who used to run the Bhatta.

5. Learned APP has opposed the prayer for anticipatory bail.

6. Be that as it may, I am inclined to admit the petitioner, above named, on anticipatory bail. The petitioner is directed to surrender in the Court below within three weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Dhanbad in connection with Chirkunda (Galfarbari) P.S. Case No. 222 of 2016, corresponding to G.R. No. 3230, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. subject to the further condition that on the date of surrender, petitioner shall deposit Rs. 20,000/- in the trial court.

7. The aforesaid deposit is subject to the result of the case.

8. Let a copy of order be communicated to the trial court.
