8/ 18.04.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner has been made accused for the offences under Sections 406, 409, 420 and 120-B of the Indian Penal Code, in connection with Godda (T) P.S. Case No. 528 of 2013 corresponding to G.R. No. 1652 of 2013.
The petitioner was the employee of ICICI Bank, Godda, and FIR was lodged by the informant, alleging that he and his family members made fixed deposits of huge amounts in the Bank and they were given the bonds of the said fixed deposits also, but from those accounts, illegal withdrawals were made on the basis of forged cheques, by the Bank officials in convenience with each other. The petitioner is also named in the FIR.
In view of the fact that during investigation, it was found that the fake accounts were opened by the Bank officials and in connivance with each other, the amounts were withdrawn from the accounts and in the present case, approximately Rs. 66,77,000/- was withdrawn, earlier bail application of this petitioner was rejected on merits by order dated 29.6.2015 in B.A. No.5204 of 2014.
Learned counsel for the petitioner has renewed the prayer for bail of the petitioner.
In the facts of this case, I am not inclined to reconsider the prayer for bail of petitioner, Pandey Biswjeet @ Bishwajeet. Accordingly, his prayer for bail is rejected.
