3/ 12.04.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner has been made accused for the offence under Sections 364 / 34 of the Indian Penal Code and Section 17 of the C.L.A. Act, in connection with Keredari P.S. Case No. 16 of 2014 corresponding to G.R. No. 1191 of 2014, S.T. No. 397 of 2015.
The case relates to abduction of the father of the informant by the members of extremist group and the case was instituted against unknown.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. It is submitted that the victim has since been recovered and his statement was recorded under Section 164 Cr.P.C., wherein, the victim has not named the petitioner, though he has named other co-accused persons. It is also submitted that in similar circumstance, other co-accused has been granted bail by order dated 4.11.2015 in B.A. No. 8273 of 2015. Learned counsel has accordingly, prayed for bail.
In the facts of this case, I am inclined to enlarge the petitioner, Rajendra Oraon, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions Judge-XIV, Hazaribag, in connection with S.T. No. 397 of 2015, arising out of Keredari P.S. Case No. 16 of 2014 corresponding to G.R. No. 1191 of 2014.
