Heard learned counsel for the petitioner as well as learned counsel for the State.

2. The petitioner is apprehending his arrest in connection with Complaint Case No. 418 of 2015, registered under Sections 29, 30(a), 30(c) of the Indian Forest Act, pending in the court of learned Sub Divisional Judicial Magistrate, Latehar.

3. It is submitted by learned counsel for the petitioner that petitioner is falsely implicated in this case. It further appears that the wooden patta were recovered from the house of this petitioner, but there is no signature of independent witnesses or any family members in the seizure list. It is submitted that till date, processes under Sections 82 / 83 has not been issued.

4. Be that as it may, the petitioner, above named is directed to surrender in the court below within three weeks from the date of this order and in the event of his arrest or surrender the court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Latehar, in connection with Complaint Case No. 418 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the condition that on the date of surrender, petitioner will deposit Rs. 10,000/- in the trial court.

5. The aforesaid deposit is subject to the final result of the case.

6. Let the order be sent to the trial court.
