Heard learned counsel for the parties.
The petitioner is apprehending his arrest in connection with Barwadda P.S. Case No. 44 of 2016, corresponding to G.R. No. 2189 of 2016, for the offence registered under sections 414, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner has submitted that that after institution of the case the petitioner approached to S.P, Dhanbad and gave application with all valid documents in relation to purchase of coal, which was found genuine.
Learned A.P.P conceded the fact submitted by the learned counsel for the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to surrender in the Court below within three weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of Sri Anup Tirkey, learned Judicial Magistrate, Ist Class, Dhanbad or his succesor in connection with Barwadda P.S. Case No. 44 of 2016, corresponding to G.R. No. 2189 of 2016, subject to condition as laid down under section 438(2) Cr.P.C.
