Heard Mr. Arvind Kumar Choudhary, learned counsel appearing for the petitioner and Md. Azeemuddin, learned APP appearing for the State.
Petitioner is an accused in connection with Deoghar (Kunda) P.S. Case No. 622 of 2015 corresponding to G.R. No. 1362 of 2015 registered for the offences punishable u/s 302/120B/34 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioner that the petitioner has been implicated only because of the fact that it has been stated by the co-accused Bhairo Singh that he has been sent by the petitioner and one Kanhai Singh in order to purchase the land and subsequently one Rajesh Kumar Yadav has also taken the name of the petitioner and that the petitioner is in custody since 21.6.2015.
Learned counsel for the State has opposed the prayer for bail of the petitioner and submitted that the name of the petitioner has surfaced in the confessional statement of co-accused persons.
Regard being had to the aforesaid fact, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Deoghar in connection with Deoghar (Kunda) P.S. Case No. 622 of 2015 corresponding to G.R. No. 1362 of 2015
