Heard Mr. Anil Kumar, learned counsel for the petitioner and Mr. Shekhar Sinha, learned counsel for the State.
The petitioner has been made an accused in connection with Panki P.S. Case No. 44 of 2013 registered under Sections 394 of the Indian Penal Code and Under Section 25(1-b) A/26,27/35 of the Arms Act.
It has been submitted by the learned counsel for the petitioner that petitioner is not named in the first information report and subsequently on the confessional statement of co-accused he has been implicated. It has further been submitted that similarly situated co-accused persons namely Sandeep Kumar Yadav @ Sandeep Yadav @ Kail Yadav and Ramwali Yadav @ Wali Yadav @ Ram Wali Yadaav @ Wali Yadav have already been granted bail by this Court in B.A No. 194 of 2014 and B.A No.6931 of 2014, respectively. The petitioner is in custody since 30.3.2015.
Learned counsel for the State opposes the prayer for bail but does not dispute the aforesaid fact.
Regard being had to the above fact, the petitioner Lali Yadav is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Palamau at Daltonganj in connection with Panki P.S Case No. 44 of 2013 corresponding to G.R No. 769 of 2013.
