Heard Mr. Sujay Dayal learned counsel for the petitioner and learned counsel for the State.
The petitioner has been made an accused in connection with Sadar P.S. Case No. 142 of 2015 registered under Sections 392 of the Indian Penal and under but subsequently charge-sheet has been submitted under Section 395/412 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioner that petitioner is not named in the first information report and subsequently on suspicion the petitioner was implicated and on the confession of the petitioner there is an allegation of recovery of scooty and Rs. 9,000/- in cash. It has further been submitted that the scooty was not a subject matter of the loot. So far as the Rs. 9,000/- is concerned the same belong to the petitioner and the test identification parade has not been held. It has further been submitted that petitioner is in custody since 23.4.2015.
Learned counsel for the State opposes the prayer for bail.
Regard being had to the aforesaid fact, the petitioner Rajesh Srivastava is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Judicial Commissioner, Ranchi in connection with Sadar P.S. Case No. 142 of 2015 corresponding to G.R No. 1994 of 2015 ( S.T No. 423 of 2015).
