Heard Mr. Mohit Prakash, learned counsel for the petitioner and Mr. Vijay Shankar Prasad, learned counsel for the State.
The petitioner has been made an accused in connection with Basia P.S. Case No. 57 of 2015 registered under Sections 341/323/324/307/504/34 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioner that allegations are general and omnibus in nature. Learned counsel further adds that admittedly there is a land dispute between the petitioner and the informant party and that the petitioner is in custody since 17.7.2015.
Learned counsel for the State opposes the prayer for bail and submits that petitioner had taken part in the assault.
Regard being had to the nature of allegation, the petitioner Siril Oraon is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Gumla in connection with Basia P. S. Case No. 57 of 2015 corresponding to G.R No. 842 of 2015.
