The petitioner is an accused in connection with S.T. No. 117 of 2004 arising out of Basishtha Nagar P.S. Case No. 45 of 2003, corresponding to G.R. No. 779 of 2003, registered for the offence punishable under sections 147, 148, 149, 323, 324, 307, 506 of the Indian Penal Code.

It has been submitted by the learned counsel for the petitioner that this is a case of misuse of privilege of bail. The petitioner was granted bail by this Court on 11.05.2005 in B.A. No. 1968 of 2005 and subsequently on account of non-appearance his bail bond was cancelled vide order dated 05.12.2005 and he was declared absconder vide order dated 1.4.2008. It has also been submitted that the petitioner is in custody since 01.05.2015.

Learned counsel for the State has opposed the prayer for bail and has submitted that the petitioner has absconded for a period of about 10 years.

Regard being had to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, F.T.C. III, Chatra, in connection with S.T. No. 117 of 2004 arising out of Basishtha Nagar P.S. Case No. 45 of 2003 subject to condition that the petitioner shall appear on each and every dates in the Court below and if he fails to appear even a single date his bail bond shall be cancelled and necessary steps be taken for his apprehension.
