2/ 04.08.2014 An urgency slip was filed by the counsel for the applicant and therefore, the matter has been listed today.

Heard the learned counsel appearing for the parties and perused the documents on record.

The applicant is apprehending her arrest in connection with Godda (Town) P.S. Case No.299 of 2010 corresponding to G.R. No. 956 of 2010 registered under Sections 420/467/468/ 471/120B of the Indian Penal Code.

The learned counsel appearing for the applicant submits that though the applicant was not appointed on the post of ANM, on the allegation that she has submitted a forged certificate, she has been named in the present case. Referring to Annexure 3, the order dated 10.05.2012 in A.B.A No.1314 of 2012, the learned counsel has submitted that another co-accused namely, Snehlata Kumari has been granted anticipatory bail by this Court and this applicant also deserves grant of anticipatory bail.

The learned A.P.P. opposes the prayer for grant of anticipatory bail.

Considering the facts and circumstances of the case, in the event of arrest of the applicant or if she surrenders before the trial court within a period of four weeks from today, the applicant namely, Babita Kumari would be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Godda in connection with Godda (Town) P.S. Case No.299 of 2010 corresponding to G.R. No. 956 of 2010.

Let a copy of this order be sent to the concerned trial court through FAX on depositing the cost by the applicant.
